Terms of service and fair use
The rules that apply to your PimComm internet service, in plain language.
Last updated: Draft, not yet reviewed
Your contract comes first. This page is a summary for the public. The agreement you receive when you sign up, together with the Critical Information Summary provided with it, is the document that governs your service. If anything here differs from that agreement, the agreement applies.
The service
PimComm provides residential and business internet access over dedicated fibre in Cross Lake, Manitoba. Plans are symmetrical, meaning the upload speed matches the download speed.
Speeds
Plan speeds are described as "up to" a stated rate. That is the speed delivered to your home or premises. The speed you actually experience on a given device depends on factors we do not control, including your wifi coverage, the age and capability of your device, how many devices are active at once, and the capacity of the websites and services you are connecting to.
Pricing and billing
Current pricing is provided when you sign up and is set out in your agreement. Installation fees for residential service are stated at sign-up. Business installation is quoted after a technician assesses your site.
[PLACEHOLDER: confirm billing cycle, due dates, accepted payment methods, late payment charges, and whether any deposit is required.]
Fair use and network management
[PLACEHOLDER: This section is required if any plan is advertised as "unlimited." Confirm whether there are data caps, whether traffic is ever shaped or throttled, and under what conditions. The CRTC Internet Code requires a published fair use policy where unlimited claims are made, and the CRTC's Internet Traffic Management Practices rules govern throttling.]
Acceptable use
You agree not to use the service to:
- Break any law
- Send unsolicited bulk email, in breach of Canada's Anti-Spam Legislation
- Gain unauthorized access to any system or network
- Interfere with the operation of the PimComm network or another customer's service
- Distribute material you do not have the right to distribute
- Resell the service without our written agreement
Your equipment and ours
[PLACEHOLDER: confirm whether the router and other equipment is owned by the customer, rented, or included. State who is responsible for damage, and what must be returned on cancellation.]
Changing or cancelling your service
[PLACEHOLDER: confirm notice required to cancel, whether there is a contract term or early cancellation fee, and the trial period. The CRTC Internet Code sets minimum trial period rights and rules on notice of price changes.]
Suspension and disconnection
[PLACEHOLDER: confirm the grounds and notice period for suspension or disconnection, including for non-payment. The CRTC Internet Code sets specific notice requirements and this text must match the customer agreement.]
Interruptions to service
We work to keep the network running continuously, but service may be interrupted by maintenance, equipment failure, weather, power loss, or events outside our control. Known interruptions are posted on our service status page.
Complaints
If something goes wrong, contact us first at 1-800-773-3336 or support@pimcommcorp.com. Most issues are resolved directly.
[PLACEHOLDER: confirm PimComm's registration with the Commission for Complaints for Telecom-television Services (CCTS). Canadian telecommunications providers are generally required to be members and to tell customers they can escalate unresolved complaints to the CCTS. This section must name the CCTS and provide its contact details once membership is confirmed.]
